Terms of use
Effective date: 8 April 2026. These Terms form a binding agreement between you and DashPay Nigeria Ltd ("DashPay", "we", "us") governing use of the Dash mobile application and related web portals and tools we operate (the "Services").
1. Acceptance
By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you are using Dash on behalf of a business, you represent that you are authorised to bind that business, and "you" includes the business. If you do not agree, do not use the Services.
2. Eligibility and accounts
You must be able to form a legally binding contract in your jurisdiction. You are responsible for providing accurate registration information, keeping your device secure, and any activity under your account. Notify us promptly at support@dashpay.com.ng if you suspect unauthorised access.
3. Nature of the Services
Dash provides digital payment, tipping, and related operational features for individuals and venues as we make them available. DashPay is not a bank, deposit-taking institution, or licensed payment service provider unless and except to the extent we expressly hold such licences and say so in writing. Balances, settlement timing, fees, programme rules, and venue-specific arrangements depend on our configuration and on agreements between you, venues, or partners. Features may vary by region, rollout phase, or account type.
4. Permitted use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not misuse the Services, attempt to disrupt or reverse engineer them except where the law allows, circumvent limits, use another person's identity, launder money, or assist fraud. We may suspend or terminate access for conduct that risks users, the platform, or legal compliance.
5. Fees and taxes
Any fees, limits, or charges applicable to you are shown in the app or in separate terms with your venue or partner. You are responsible for any taxes applicable to your use of the Services unless stated otherwise.
6. Intellectual property
DashPay and its licensors own the Services, including software, branding, and content we provide. We grant you a limited, revocable, non-exclusive licence to use the Services for personal or, where applicable, internal business use in line with these Terms. You receive no ownership rights in our intellectual property.
7. Third-party services
The Services may link to or interoperate with third-party sites, banks, or processors. Their terms and privacy notices govern those relationships. We are not responsible for third-party content or failures outside our reasonable control.
8. Disclaimers
To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty arising from course of dealing or usage. We do not warrant uninterrupted or error-free operation. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Limitation of liability
Subject to applicable law, DashPay and its affiliates, directors, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, goodwill, data, or opportunities, arising from your use of the Services. Our aggregate liability for claims relating to the Services in any twelve-month period is limited to the greater of amounts you paid us in fees for the Services during that period (if any) or the equivalent of fifty thousand Nigerian naira (NGN 50,000), except where a higher minimum applies by law. These limits do not apply where prohibited.
10. Indemnity
You will defend and indemnify DashPay against third-party claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Services, breach of these Terms, or violation of law, except to the extent caused by our wilful misconduct.
11. Suspension and termination
We may modify, suspend, or discontinue parts of the Services for maintenance, security, legal, or commercial reasons. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Courts in Nigeria shall have exclusive jurisdiction for disputes arising from these Terms, unless mandatory consumer protections in your place of residence require otherwise.
13. Changes
We may update these Terms. We will post the revised version on this page with a new effective date. Where required, we will provide additional notice in the app. Continued use after the effective date of material changes constitutes acceptance where the law allows.
